1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of Garnish ("we," "us," or "our") website, services, and applications (the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms. If you do not agree to these Terms, you may not use the Service.

2. Service Description

Garnish provides an AI-powered essay humanization service that transforms AI-generated text into more natural-sounding writing (the "Service"). The Service is provided on an "as-is" and "as-available" basis.

3. Eligibility

You must be at least 13 years old to use the Service. If you are between 13 and 18, you represent that you have your parent or legal guardian's permission to use the Service. The Service is not intended for users under 13.

4. Account Registration and Security

You may be required to create an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to protect your account.

5. Acceptable Use and Prohibited Conduct

You agree to use the Service only for lawful purposes and in compliance with all applicable laws, regulations, and institutional policies. You are solely responsible for the content you submit ("Input") and the manner in which you use the Service's output ("Output").

Please note: Any use of our Service for illegal or prohibited purposes may be reported to relevant authorities.

You must not:

• Use the Service to produce content that violates any applicable law, including intellectual property, privacy, or export control laws.
• Use the Service to create content that is defamatory, harassing, abusive, threatening, hateful, or otherwise objectionable.
• Use the Service to commit academic fraud, plagiarism, or any form of academic dishonesty, including submitting Output as your own work in violation of your institution's policies.
• Reverse engineer, decompile, or attempt to extract the source code of our AI models or any part of the Service.
• Use the Service to develop competing products or services.
• Bypass or attempt to bypass any rate limits, security features, or usage restrictions we have implemented.
• Use the Service in a way that could damage, disable, overburden, or impair our servers or networks.
• Submit any content that contains malware, viruses, or other harmful code.

6. Intellectual Property Ownership

Your Input and Output: As between you and Garnish, you retain all ownership rights, including any intellectual property rights, in your Input and the Output generated specifically for you by the Service. Garnish claims no ownership over your Input or Output.

Our License to Operate: By submitting Input to the Service, you grant Garnish a worldwide, non-exclusive, royalty-free, and fully paid license to use, reproduce, and modify your Input solely for the purpose of providing, maintaining, and improving the Service. This license terminates when you delete your Input or your account, except for copies retained for legal compliance or dispute resolution.

Our IP: Garnish and its licensors own all right, title, and interest in and to the Service, including all underlying technology, software, algorithms, user interfaces, trademarks, and copyrights. You may not copy, modify, or distribute any part of the Service without our prior written consent.

7. Payment Terms

Certain features of the Service may be offered on a paid subscription basis ("Paid Plans"). Paid Plans are billed on a monthly recurring basis. You authorize us to charge your chosen payment method at the beginning of each billing cycle. You may cancel your subscription at any time through your account settings; cancellation will take effect at the end of the current billing period. Refunds are provided at our sole discretion. We may change our pricing upon 30 days' notice, which will apply to subsequent billing cycles.

8. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for any reason, including if we believe you have violated these Terms or engaged in conduct that harms our platform. Upon termination, your right to use the Service will cease immediately, and we may delete any associated data. If we terminate your account for cause, you are not entitled to a refund of any prepaid fees.

9. Disclaimer of Warranties and No Detection Guarantee

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

GARNISH DOES NOT WARRANT THAT THE OUTPUT WILL MEET YOUR REQUIREMENTS, BE ERROR-FREE, OR BE SUITABLE FOR ANY PARTICULAR PURPOSE. Specifically, while Garnish strives to produce high-quality humanized text, we do not guarantee that any Output will pass any specific AI detection tool, as detection algorithms are updated frequently and results may vary. You acknowledge that Output may contain errors, inaccuracies, or "hallucinations," and that Output generated for you may not be unique and could be similar to Output generated for other users.

WE ARE NOT RESPONSIBLE FOR ANY CONSEQUENCES ARISING FROM YOUR USE OF OUTPUT, INCLUDING BUT NOT LIMITED TO: (A) DETECTION OF OUTPUT BY ANY AI DETECTION, PLAGIARISM, OR CONTENT ANALYSIS SYSTEM; (B) ANY ACADEMIC OR DISCIPLINARY ACTION TAKEN AGAINST YOU BY ANY EDUCATIONAL INSTITUTION, EMPLOYER, OR OTHER ORGANIZATION; OR (C) ANY VIOLATION OF INSTITUTIONAL POLICIES, HONOR CODES, OR LAWS RESULTING FROM YOUR USE OF OUTPUT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL GARNISH OR ITS AFFILIATES, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. THESE LIMITATIONS APPLY EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

11. Indemnification

You agree to indemnify, defend, and hold harmless Garnish and its affiliates, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your access to or use of the Service; (b) your violation of these Terms; (c) your misuse of the Service, including any academic or disciplinary consequences; or (d) your violation of any third-party right, including any intellectual property or privacy right.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any dispute arising from these Terms or the Service shall be resolved exclusively in the state or federal courts located in New Castle County, Delaware. You agree to waive any right to a trial by jury or to participate in a class action. Any claim you bring must be filed within one (1) year after the cause of action arises.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by posting the updated Terms on our website or by sending you an email (to the address associated with your account). Your continued use of the Service after the changes are posted constitutes your acceptance of the revised Terms.

14. Miscellaneous

• Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
• Waiver: Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
• Entire Agreement: These Terms constitute the entire agreement between you and Garnish regarding the Service and supersede any prior agreements.
• Assignment: You may not assign these Terms without our prior written consent. We may assign these Terms without restriction.
